Federal Court Dismisses Plaintiff's Due Process Claims Against Public School District

Plaintiff asserted deprivation of liberty and property interests in violation of due process clause after being terminated as superintendent of a public school district. Plaintiff also asserted several state law claims. The court granted the school district’s motion to dismiss the federal claims and declined to exercise pendent jurisdiction of the state law claims. The court held that plaintiff’s remedy for any due process deficiency arising from his termination was to appeal to chancery court and that plaintiff failed to state a claim for deprivation of a liberty interest.
