Driskell and Watson Get Case Dismissed in Washington County
Plaintiff sued a local family company and their driver over a car accident where the Plaintiff herself ran a stop sign. Plaintiff filed the suit in Washington County. She argued that the company driver was driving too fast and was at least partially at fault for the accident. Daniel Coker attorneys Mitchell Driskell and Marissa Watson represented the local company and driver. They discovered that a store near the intersection captured the accident on the store’s surveillance video system. Driskell and Watson used that video, and an expert witness, to prove by a frame-by-frame distance traveled analysis that the defendant driver was not speeding and was visible as he approached the intersection. With this evidence, the Court granted defendants’ motion for summary judgment and the case was dismissed. Mitchell and Marissa both work in our Oxford office.
