Summary Judgment Granted to Defendant Employer in Jackson County Circuit Court

The Circuit Court of Jackson County, Mississippi, granted summary judgment in favor of an employer sued for wrongful death by the heirs of its employee who had been electrocuted as a result of coming in contact with an underground cable while removing a tent from an event that occurred in Pascagoula, Mississippi. The Court found that the conduct of the employer was not intentional; thus, Plaintiff’s claim was barred under the exclusive remedy provision of the Mississippi Workers’ Compensation Act.
