DANIEL COKER SECURES DEFENSE VICTORY IN ROAD-RAGE COLLISION CASE
Daniel Coker attorneys Kristi Rogers Brown and Randolph S. Mikell recently secured a favorable jury verdict for their client in a motor vehicle accident case involving disputed liability. The case stemmed from a collision in which the defendant driver was operating a vehicle in the course and scope of his employment. Both the driver and his employer were named as defendants in the lawsuit.
The Plaintiff alleged that the defendant driver had been tailgating her in the left lane of a highway before overtaking her in the right lane, merging back in front of her vehicle, and then deliberately slamming on his brakes—causing a rear-end collision. She attributed the defendant’s actions to an episode of road rage.
The defense presented a different account. The defendant driver denied intentionally braking and instead testified that the Plaintiff exhibited aggressive behavior and was responsible for causing the accident. Throughout the trial, Kristi Rogers Brown emphasized the importance of evaluating the demeanor and credibility of the parties in determining fault.
The Plaintiff claimed a rotator cuff tear and sought approximately $79,000 in economic damages, along with an additional $450,000 in non-economic damages. After less than an hour of deliberation, the jury returned a verdict in favor of both defendants, finding no liability.
