DISMISSAL OF CLAIM BASED UPON LACK OF MEDICAL CAUSATION

Daniel Coker attorney Robert Stacy obtained partial summary judgment for his client limiting plaintiff’s damages in an automobile accident case pending in the Circuit Court of DeSoto County, MS. Plaintiff alleged she suffered a cervical spine injury and surgery as a result of an automobile accident. No physician would causally relate the cervical injury and surgery to the accident. Plaintiff failed to meet her burden of proving to a medical probability that the injury and surgery were caused by the accident.
