Federal Court Grants Summary Judgment in Case Involving Local Police Officer

A federal court in the Northern District of Mississippi granted summary judgment in favor of a local city and police officer in a case alleging violations of Fourth and Fourteenth Amendment rights pursuant to Section 1983, federal conspiracy claims pursuant to Section 1985, and state-law claims of false arrest and assault.  For the federal claims, the Court found no constitutional violation and that plaintiff failed to state a conspiracy claim.  For the state-law claims, the Court found that the statute of limitations had expired and that plaintiff failed to comply with pre-suit requirements.   The case was summarily dismissed as to all claims.  Attorney Wilton “Trey” Byars represented the officer in this action.
