Judgment As A Matter Of Law For Defendant Homeowners In A Premises Liability Lawsuit

Obtained judgment as a matter of law for defendant homeowners in a premises liability lawsuit in the Circuit Court of Jefferson County, Mississippi.  The Plaintiff alleged that deteriorated flooring was a dangerous condition that caused him to fall through the floor resulting in an injury to his knee and genitals.  The Court held that plaintiff did not sustain his burden of proving the existence of a dangerous condition, or that any such condition was the proximate cause of his injuries, or that the homeowners were negligent in any way.
