Summary Judgment Granted for Defendant in Constructive Discharge Employment Case

A federal district court granted the firm’s client summary judgment in a constructive discharge claim filed by a transgendered former employee. The Court agreed with the employer’s contentions that the plaintiff lied during the application process and found that, regardless of the plaintiff’s qualifications for the position or her misrepresentations during the application process, she was not placed in a situation that was so intolerable that she was left with no choice but to resign her position.
