Taylor and Van Camp Win Partial Summary Judgment

In the Circuit Court of Jackson County, Ed Taylor and Katie Van Camp obtained a partial summary judgment for a trucking company as to Plaintiff’s wrongful death claim. Plaintiff claimed the deceased developed liver failure and died as a result of taking Lortab for pain associated with a cervical fracture suffered in the accident. The Court held that the deceased’s death was not legally foreseeable, and the death claim was dismissed. An interlocutory appeal has been filed with the Mississippi Supreme Court.
