U.S. Fifth Circuit Court Of Appeals Reverses a District Court’s Order

U.S. Fifth Circuit Court of Appeals REVERSES a District Court’s order granting plaintiff’s/appellee’s motion for summary judgment in a breach of contract/declaratory judgement action seeking recovery of federal income taxes paid by Plaintiff which were being contested by the employee in U.S. Tax Court. Fifth Circuit further grants defendant’s/appellant’s request to stay the District Court proceedings pending the outcome of the defendant’s/appellant’s challenge to the claimed federal tax liability in U.S. Tax Court proceedings.
