Appeals Court Affirmed Summary Judgment

The Mississippi Court of Appeals affirmed a trial court decision granting a summary judgment in favor of a wholesaler who provided allegedly defective Chinese drywall that was used to construct a house.  The wholesaler was deemed to be an innocent seller pursuant to the Mississippi Product Liability Act.

Summary Judgment Obtained in Jones County

Summary Judgment was obtained in Jones County, Mississippi, in favor of a drywall wholesaler.  Plaintiff’s claim involved “Chinese drywall” which had been purchased by their contractor from our Defendant wholesaler.  The Court granted summary judgment pursuant to the innocent seller provision of the Mississippi Products Liability Act.
