Byars Win Summary Judgment

Trey Byars represented a police department defendant in a case involving allegations of negligence, violation of due process rights, and wrongful seizure in violation of the Fourth Amendment. Plaintiffs sought over five million dollars jointly and severally against all defendants.  The police department defendant moved for summary judgment pursuant to immunity under the Mississippi Tort Claims Act, the expiration of the statute of limitations, non-compliance with pre-suit requirements, and failure to state a constitutional claim.  The court found for the police department as to all claims.
