Byars and Forks Obtained Defense Verdict in Action Filed Against City

Plaintiffs sued the city under the Mississippi Tort Claims Act alleging that a local police officer acted with reckless disregard. The officer’s vehicle struck the plaintiffs’ vehicle while the officer was responding to an emergency call. The officer was operating his lights, siren, and air horn. Following a bench trial, the Court found that the police officer showed care in his response to the emergency call and, therefore, did not act with reckless disregard. The Court further ruled that the officer’s response was reasonable under the circumstances. The lawsuit was filed in the Circuit Court of Lafayette County, MS.
