Dismissal Of Plaintiff’s Premises Liability Lawsuit in Harrison County

Obtained dismissal of plaintiff’s premises liability lawsuit against a local restaurant on motion for summary judgment in the Circuit Court of Harrison County, Mississippi, Second Judicial District.  The Plaintiff alleged that a landscape light in the garden area of the courtyard was a dangerous condition that resulted in burns to a three year-old child.  The Court held that plaintiff did not sustain her burden of proof in her claim that a dangerous or hazardous condition existed or that the restaurant was in any way negligent in its placement or maintenance of the light.
