Federal Due Process Claims against a Public School District Dismissed

Silas McCharen obtained summary judgment in a case where a superintendent was terminated by a public school district.  Plaintiff alleged violations of his liberty interests and argued that he was deprived of his right to a “name clearing hearing” upon termination.  The Court, agreeing with defendants, found that the charges against plaintiff did not rise to a level where a “name clearing hearing” was warranted.
